Insurance Quote Request Forms.

  • Please read the following terms and conditions related to utilizing 4freequotes.com Inc.'s ("4freequotes", "the Insurance Directory”) insurance quote request forms via a link from your website or home page. Upon agreement to the terms as defined below, you- the agency principal, agent, broker, or authorized representative (“Insurance Professional", "You", "Your”)  may complete our application.

  • Terms

    4freequotes shall, upon receipt of the executed agreement along with appropriate fee set forth in application,  provide You, the Insurance Professional with the HTML code ("the Code")  necessary to link directly to our insurance quote request forms. The code is valid for a period of one year from the day 4freequotes provides the customized code via email. Continuation beyond the one year period will require payment of the renewal fee as detailed in the renewal offer You will receive prior to the termination of the one year period.  The Code supplied by 4freequotes may only be used on any page or directory within the domain you supply on our agreement form as discussed in detail below. The Code remains the exclusive property of 4freequotes.com, Inc. and it may not be sold, given, exchanged or otherwise transferred.  4freequotes.com, Inc. reserves the sole right to choose which Insurance Professionals may access our quote forms.
  • Valid use:

    Should Your web site or web page be a subdirectory of a domain not owned by You- i.e.: http://members.aol.com/~xyzagency/ ,only pages in the /~xyzagency/ directory owned and utilized by your agency will be authorized to execute the script.
  • If You own the domain name i.e.: http://www.youragency.com , You may use the Code on any and all pages within the domain. When the Code is executed from an unauthorized domain, an email is sent directly to 4freequotes.com with the address of the URL that tried to execute it.
    SHOULD THIS OCCUR, You forfeit your payment and You will be banned from using 4freequotes' forms. It's not worth it, so please refrain from attempting to illegally use 4freequotes Code from another domain. You agree not to sell, give or otherwise transfer the Code to any other party. Exclusive use is granted within the confines defined by this disclaimer, and should unauthorized sale, or transfer of such code occur, You hereby agree to indemnify 4freequotes for triple the value of the sold, given or otherwise transferred Code.
  • If Your agency has two domains, i.e. Johnsonagency.com and ca-autoins.com You may purchase the right to use the Code on Your other domain(s) for an additional charge, BUT the domain must be owned by Your company(we check every URL requesting use of our forms).
  • All insurance quote requests submitted through the execution of the Code on Your web site will be emailed directly to You at the address supplied by You when completing our application. 
     
  • Licensing of Insurance Professionals

    As a prerequisite to obtaining the Code, You represent and warrant to 4freequotes that: (1) You are properly licensed in each state that You do business; (2) You are properly authorized to advertise and sell each product or service referenced in Your home page; (3) all statements or representations made by or on Your behalf in your home page are clear, truthful and not misleading; (4) the contents of the Your home page are truthful, fair and lawful; and (5) that the use of any name, picture, likeness, reproduction, endorsement, copyrighted item, telephone number, address, trademark, service mark or trade name in, or in connection with You is duly authorized.  You shall immediately advise 4freequotes with respect to any portion of Your home page which violates any of the foregoing warranties.

    You assume sole responsibility for the protection of any copyrights, trademarks, service marks and trade names owned wholly or partially by You or which You are duly authorized to use, whether or not included in the home page, and shall hold 4freequotes free and harmless from and against any and all liability for infringement thereof.  You agree to respond to all quote requests in a timely fashion to the best of Your professional ability.
  • Limitation of Liability

    • 4freequotes disclaims any liability for information submitted through the Code on Your web site including or unauthorized use of the Your information by a third party.

    Any claim by the You arising out of a breach of the terms hereof by 4freequotes shall be waived unless You give 4freequotes written notice thereof within thirty (30) days of the alleged breach by 4freequotes.  4freequotes shall not be liable for any lost profits or damages for any breach of 4freequotes’ obligations hereunder. 

    In the event a court of competent jurisdiction determines that 4freequotes has breached the terms hereof, Your exclusive remedy shall be limited to 4freequotes’ replication of the services in order to correct any such breach..

    4freequotes shall be given a reasonable opportunity to investigate all claims of alleged breach.  You agrees to, and hereby do, indemnify, defend and hold 4freequotes, its principals, employees and agents, harmless from and against any and all loss, claim, damage, expense, penalty, demand, reparation, cost of defense, attorneys’ fees or liability whatsoever arising out of or in any way caused by or in connection with the services furnished pursuant to this Agreement.  You shall hold harmless 4freequotes, its principals, employees and agents from any action brought by a consumer or business entity.  In no event shall 4freequotes, its principals, employees or agents be held liable for any damages arising out of or in connection with the use or misuse, errors or omissions with regard to the information contained on 4freequotes’ web site or submitted by consumers via the quote request forms.

    You acknowledge that the Insurance Directory may experience interruption in service and access for reasons that may be within or beyond the control of 4freequotes .  Accordingly, 4freequotes shall not be liable for any incidental, consequential, exemplary, or special damages, including but not limited to lost profits and damages arising from loss of business even if  4freequotes has been advised of the possibility of such damages and whether any such damages are based on contract, tort, strict liability or any other legal theory.

    4freequotes disclaims all express, implied, and statutory warranties with respect  to the  access  and services provided hereunder, including but not limited to the implied warranties of fitness for a particular purpose, merchantability and non-infringement of third party rights.
  • Independent Contractor Status

    No party hereto nor any person acting on behalf of it shall be deemed an employee of the other party to this agreement for any purpose whatsoever. This agreement shall be governed by, and construed in accordance with the with the laws of the State of New York, including, without limitation, those relating to conflict of laws. Any action or lawsuit brought by any of the parties hereto, shall be filed and adjudicated in Nassau County, New York. This agreement shall only be amended in writing, executed by duly authorized representatives of the parties.
  • Payments

    Since there are no set-up charges, the annual quote form usage fee is fully earned upon creation of the custom Code.  A $20 bounced check fee will apply to all NSF checks returned by our bank. If replacement funds are not received within 15 days of agent notification of a check returned for insufficient funds, the Code will be rendered invalid by 4freequotes.
